1. General provisions

  1. The following regulations specify How the online store works and how to enter into sales contracts for products through this Store.

  2. The rules of procedure are addressed to both consumers and businesses using the Online Shop. The rules are not intended to exclude or restrict any rights of consumers under mandatory law. In the event of a conflict between the rules of procedure and the mandatory rules of procedurethe mandatory rules of law shall prevail.

  3. Definitions:

    2. The customer - an entity having the full legal capacity and, in the cases

      provided for by the regulations, an entity with limited legal capacity;a legal person or an organizational entity without legal personality, the law of which confers legal capacity which intends to conclude a Sales Agreement with the Dealer.

    3. online store – the dealer’s online store available under the address: www.factorydesign.art

    4. Product – a portable item available in the online store being the subject of the sales contract.

    5. An order - a declaration of the customer, leading directly to entering into a sales contract

    6. A business day – one day from Monday to Friday, excluding public holidays.

2. Online store

  1. Registration is necessary for on-line purchases through the Shop.

  2. The price of the Product shown on the website of the Online Store is stated in Polish

    zloty (PLN) or EURO (EUR) and includes value added tax (VAT) at a rate determined

    in accordance with current regulations.

  3. The product information provided on the Internet Shop website, in particular its

    descriptions, technical and operational characteristics and prices, constitutes an

    invitation to a sales contract within the meaning of Article 71 of the Civil Code.

  4. lacing an order through this Store is equivalent to allowing the Dealer to issue an

    invoice without having to obtain a Customer's signature.

  5. In the event that Customer breaches any of the laws, regulations or Privacy Policy, or in the event that Customer is acting in a manner that makes it harder for the shop to work or is burdensome for other Customers, the dealer shall be entitled to revoke the customer’s right to use the store and/ or r​ the goods offered in this Store.​

3. Ordering and delivery

  1. Ordering products is possible in the following ways:

    To complete your order, you must fill the form on the online store page correctly.

  2. Customer order must be confirmed by the Dealer. The dealer acknowledges the order by e-mail to the e-mail address provided by Customer within 2 business days of submission.

  3. Customer is entitled to make changes to the order or cancel it until the Dealer confirms acceptance of the order.

  4. If it is impossible to confirm the order due to Customer's fault, in particular due to incorrect Customer contact information (e.g. telephone number or email address), the order will be canceled within 3 business days.

  5. The order processing time for any product is defined on the Online Store page.

  6. Couriers delivers orders according to their own pricing to the address provided by the

    customer

  7. Delivery of the Product does not include bringing the Product into your home, so

    ensure that you have sufficient resources to bring the Product to your final destination.

  8. Upon receiving the delivery please pay particular attention to the condition of the

    package you received. If the package is damaged, please write down the protocol in the presence of a courier. Failure to draw up a report may result in the complaint being rejected.

4. Payment methods

1. A customer may pay by:

5. Complaint

  1. The Dealer's responsibilities to Customer if the Product sold has a physical or legal defect (warranty) are determined by applicable law, in particular the Civil Code.

  2. The dealer is bound to deliver the product to the customer without any defects.

  3. A complaint may be filed:

  4. The claim description should contain: details and circumstances concerning the

    product, especially nature and date of defect occurrence; preferred method of restoring product’s compliance to the sales contract or declaration of price reduction or withdrawal from the sales contract; and contact information.

  5. The Dealer shall respond to the Customer's claim as soon as possible, within 14 calendar days of the date of submission of the claim. Failure of the Dealer to respond within this period means that the Dealer found the claim to be justified.

  6. In the event that, in order for the dealer to respond to the customer’s claim, or to fulfill customer’s warranty rights, it will be necessary to provide the Product to the Dealer, the Customer will be asked by the Dealer to provide the Product at the Dealer's expense to 11 Listopada 2/4, 42- 400 Zawiercie.However, if due to the nature of the defect, kind of the Productor the way it is mounted, it is impossible or excessively difficult to deliver the product, the customer shall be asked to make the product available, upon prior time agreement, at the place where it is located.

  7. The product delivery request referred to in Section 6, shall not affect the Dealer's time response to the Customer's claim, and shall not prejudice the Customer's right to request the Dealer to remove the defective product and to reinstall the repaired product.

6. Withdrawal from the sales contract

  1. In accordance with Article 27 of the Consumer Rights Act of 30 May 2014 (heading 827) The client who is the consumer, who has concluded a distance or off-site contract may withdraw from the contract within 14 days without giving any reason or without incurring any costs.

  2. The withdrawal period shall begin from the date of delivery of the Product to the Customer or any third party designated by him.

  5. In the event of withdrawal from the contract in accordance with the above terms, the

    Reseller shall, no later than 14 days after receiving the Customer's withdrawal statement, return to the Consumer any payment made by him if the Consumer has chosen the cheapest possible way to deliver the product.If the consumer didn’t choose

the cheapest delivery method, the Product will be reimbursed at the rate of delivery of

the product ordered up to the lowest available shipping option.

  1. The customer must return the Product to the Dealer no later than 14 days after the

    withdrawal date, unless the Dealer has proposed that they will pick up the product. To meet the deadline, simply send the product back before it expires. Please securely pack the returned product and write "RETURN" in a visible spot. The customer bears the direct costs of return.

  2. Funds will be returned to Customer by the same payment method the Customer has used, unless Customer expressly agrees to another payment method which does not incur any cost to Customer.

  3. In respect to Article 38 of the Consumer Rights Act, the consumer shall not be entitled to withdraw from the distance contract, with regard to contracts:

    • -  In which the granted product is non-prefabricated, produced according to the specifications of the Consumer or to meet his own individual needs,

    • -  Where the product on delivery, by its nature, is inseparably linked to other parties.

  4. The seller may withdraw from the contract in the event of an obvious error in the price of the goods (the price of the goods is clearly different from the normal price of the same type, quality, type, etc.)

  5. The customer is only responsible for any reduction in the value of the goods resulting from the use of the goods in a manner other than that which is strictly necessary.

  6. Furniture marked "Post exposition" cannot be returned.

7. Final provisions

  1. Contracts made through the Online Store shall be concluded in accordance with Polish law and in Polish.

  2. Amendments in the rules:

    1. The dealer reserves the right to amend the Terms and Conditions for

      important reasons, such as: Changes in the laws; changes in payment and delivery methods; changes in the scope, remuneration or form of the Electronic Services provided; changes in dealer's address to the extent that such changes affect the implementation of these Terms and Conditions.

    2. These Terms and Conditions will in no way affect the rights of consumers using the online store prior to the date of entry into force of the Amendment. Changes to these Terms and Conditions will not affect any already placed or assembled Orders, nor any agreements entered into, implemented or executed on the Sale.

    3. In the event that an amendment would result in incurring any new costs or increasing previous costs, a consumer has the right to withdraw from the contract.

3. In the matters not covered by these Rules of Procedure, the civil code (2014, item 121, as amended) and the Consumer Rights Act of 30 May 2014 ( 2014, item 827) shall apply.
